Unk

Ran across our radio station's CD copy of "Still feel gone" today-it was laying out for some reason. The review?

"Jangly acoustics & stuff like that. Your standard but maybe above avg. alt. rock band."

From the supreme court: FCC! FCC! FCC!

I guess there was an allowance for a "fleeting expletive" for off the cuff usage of bad words (relating to poo or doing it). Not any more, though. 5 to 4 vote seals the deal. From the justices:

Bader-Ginsberg:
"there is no way to hide the long shadow the First Amendment casts over what the commission has done."
nice.

Stevens:
"As any golfer who has watched his partner shank a short approach knows," said Stevens, an avid golfer, "it would be absurd to accept the suggestion that the resultant four-letter word uttered on the golf course describes sex or excrement."
I heard that.

Scalia:
The FCC "could reasonably conclude that the pervasiveness of foul language, and the coarsening of public entertainment in other media" justified a stricter policy "so as to give conscientious parents a relatively safe haven for their children."
This guy just can't defend his "strict constitutionalist" thing, can he? Oh wait...there's more:
"it's conceivable" (that in the future the FCC may) "cause some broadcasters to avoid certain language that is beyond the Commission's reach under the constitution,".... but "we decline to address the Constitutional questions at this time."
ahh, it's okay with me, Tony, you're the smart one.

and Kennedy:
"If agencies were permitted unbridled discretion, their actions might violate constitutional principles of separation of powers and checks and balances"
YEAH!
wait....isn't that what you're doing right now?
